Another lawsuit that Erin will win

carouseltract.jpgDevelopers were so resourceful in the sixties--when they wanted to build single family houses on a 50 acre tract formerly used as an oil tank farm, they just slapped a cute name like Carousel on it and watched the buyers roll in. Flash forward, and about 285 homeowners in the Carson neighborhood of Carousel are in the middle of a lawsuit against Shell Oil, developer Barclay Hollander Corporation (now owned by Dole Foods), and others, following the discovery of scary amounts of methane and the carcinogen benzene in the land. Activist Erin Brockovich brought in her go-to law firm Girardi and Keese to represent the homeowners. According to the LA Times, Shell used the land to store oil in concrete tubs covered with wood from 1924 until the mid-sixties. Lawyer Tom Girardi says Shell knew the area was polluted when it sold it, and the executive officer of the Los Angeles Regional Water Quality Control Board, which is overseeing soil testing in Carousel, told the LAT no one would be allowed to build on the site today.

In December the Daily Breeze reported that real estate agents are having trouble closing escrow in Carousel, and that "There are almost no 'For Sale' signs up in the neighborhood, because agents have learned that they draw too much negative attention." All of the experts the paper rounded up seem pretty horrified at the contaminant levels, and the water board has told residents not to eat food grown in their yards. The LAT and the Daily Breeze have both dug up plenty of anecdotes about surprising health issues.
The water board says Shell is responsible for the cleanup, but Shell says it's the developer's problem. That is, if there even is a problem and if it's even caused by the former oil storage. The LAT says "Gene Freed, Shell's project manager, said chemical residue at some homes could have been left behind by previous owners who enjoyed fiddling with cars, or been from pesticides or other household chemicals."

The man at the center of what may be the worst corruption scandal in California history was in court today, dozing off.
Robert Rizzo, the former city manager of Bell, Calif., shocked the nation when it was revealed that his salary in office was $800,000 a year.
Now, the Justice Department has uncovered a document that may help explain, in part, how city leaders financed their lavish salaries. The one-page memo was titled "Bell Police Department Baseball Game."

"All of this was just a means by Rizzo to nickel and dime the community to death to get more money out of them," Christina Garcia, a community activist, said.

The memo assigned "hits" to traffic violations and infractions. Officers could score a "single" by giving out parking tickets. Impounding a car was worth a "triple." Police in Bell charged up to $2,000 for drivers to get their vehicles back -- many times more than any other community in the Los Angeles area.
Bell took in $1 million by impounding cars in 2008.
"This was a conspiracy, this was several people who said we are going to screw this community out of their livelihoods, and some people lost their homes," Bell resident Nester Enrique Valencia said.
Bell Police Officer Kurt Owens said he suffered consequences when he objected to the policy.
"I got a negative evaluation because I was in opposition to this plan, and it said right in there, that I don't go along with the program," he said.
Former Police Chief Randy Adams, who made more than $400,000 a year, has not been charged with any crime.
"I know that one day Police Chief Randy Adams went out there and impounded something like 15 cars just to give a lesson to his officers," Garcia said.
The U.S. Justice Department is investigating to determine if Bell city leaders were violating the citizens' rights. The deeper they dig, the more outrageous it appears to members of the community.
In a statement, the police union said the memo was "merely a parody of Robert Rizzo's profoundly nonsensical 'towing policy.'"

Erin Brockovich may be the most famous class action plaintiff—so famous, in fact, that Julia Roberts played her in a movie named after her. But she’s certainly not the only lead plaintiff to claim restitution from a misbehaving corporation, not to mention the thousands of other plaintiffs behind each case who may not even know about their involvement until they receive settlement checks.
How Class Action Suits Work
According to the legal-consulting Web site FreeAdvice.com, there are three requirements for certification of a class action lawsuit: the claim must be deemed legal; the group of plaintiffs must have the same complaint and be of such size that individual claims would be too time-consuming and costly for the court; and the lead plaintiff must stand to represent the entire class fairly and accurately, and ensure that monetary awards are distributed appropriately.
Once attorneys have obtained certification from the court, the original plaintiffs must notify potential claimants of the lawsuit through mail and media. Those notified may opt in to the lawsuit or choose not to participate. Here’s where it gets tricky. If an individual joins the suit, she will be unable to pursue future claims against the company. If she fails to opt out by missing the deadline to do so, she will still be represented in the case and will forfeit future claims, regardless of the court’s decision.
That’s a great reason to read all your mail carefully.
Pacific Gas and Electric
With Erin Brockovich as lead plaintiff, attorneys of the class action lawsuit against Pacific Gas and Electric (PG&E) in 1993 alleged that the company was aware that harmful chemicals—especially hexavalent chromium, also known as chromium(VI)—used in production were seeping into the groundwater and contaminating the water supply in the surrounding town of Hinkley, California. As a result of ingesting chromium(VI), Hinkley residents became ill with various forms of cancer and fertility problems, among other health issues.
According to David Seaman of MainStreet.com, the PG&E case resulted in the largest settlement ever paid in a direct action lawsuit in U.S. history. The court ruled in favor of the Hinkley citizens in 1996, and the energy company was forced to pay a total of $295 million to 1,100 people (about $268,000 per person).

Blondes what would we do with them / joke of the day

Last year I replaced all the windows in my house with that expensive double-pane energy-efficient kind, and today, I got a call from the contractor who installed them. He was complaining that the work had been completed a whole year ago and I still hadn't paid for them. Hellloooo,.............just because I'm blonde doesn't mean that I am automatically stupid.. So, I told him just what his fast-talking sales guy had told me last year, that in ONE YEAR these windows would pay for themselves! Helllooooo? It's been a year! I told him. There was only silence at the other end of the line, so I finally just hung up. He never called back. I bet he felt like an idiot.

Dating..?? how fun can it be

someone ask me if i would like to go to a concernt and if we go would i like to see Madonna in concert.. well will see when she will return til then hoping that the i will be able to see her in concert i know she has been through many generations and have the rythm.  She is still selling all her albums and most of them has become no 1 in the top charts.

Teenage pregnancy

Is very important that we talk to our kids bout sage sex especially our teenagers whose hormones go off the wall and most of the time they don't think about what they r doing. Also there is a lot of peer preasure in school we don't want our kids to loose focus on school n become a parent at a young age. Many parents don't know how to talk to their kids about sex so please talk to them to avoid regrets later in life.

Mey "La Honey"

On June 20 2011 my cousin Mey lost her battle to Kidney Failure its been a struggle on how to overcome and move to the next level sometimes we all wonder if we could have done something different or what if?  She was strong cus everytime she was in ER she said i will not let this battle take over me and i will over come with God help.  She did for 10 yrs and finally her body was too weak speacially her heart.  I miss her alot cus she did things that no one ever done for me.  She always went out of her way to help me out and made me smile.

Hoping this little note will make someone change their habbits and do a change on how to treat their bodies.

Work

its fucked up when you work work and work and the environment where u work at its unfair.  there are a few bad apples at my work whose r lazy, always on personal phone call or cheating on their husbands.

the managers dont say anything to them and this been goin on for years i been there for 14yrs n has not changed a bit..

should i say i hate my job or be happy that i have a job?

The Secret

I wanted to share a little wisdom I got after reading the book the secret, its an amazing book in which I recomend to everyone! I believe that truly the book makes a lot of sense, the things going on in ones life are attracted by our own thoughts...there is so much wisdom to gain from the book, I dont want to sound like I am promoting the book but simply you make out of your life what you want from it. On a completly different note, im just getting the hang of blogging so just bare with me...my post will get more and more interesting.
